WP 12 Mediation in insolvency

Introduction

This Working Party considers the role of mediation in restructuring and insolvency proceedings. Mediation can be especially helpful when formal insolvency proceedings are not yet commenced, and where widely differing interests of stakeholders must be brought together. At present, it is unclear how mediation is applied across Europe and what are the barriers for its further development.

This CERIL project has developed a three-part study consisting of the legal framework on the use of mediation, the current and future practices, and the role of the mediator in restructuring and insolvency. It aims to increase the understanding of the current barriers for use of mediation and offer recommendations to promote its potential.
